1. Parties and Purpose
This Membership Agreement (“Agreement”) is entered into between Tematek Textile and Information Technologies Industry and Trade Limited Company (“Tematek”), the operator of the DesignCAD customer portal, and the person creating a customer account in the portal (“User”). It governs the creation and security of the customer account and the conditions for using portal services.
2. Account Creation
The User verifies the account using a verification code sent to an email address owned by and accessible to the User. The first name, last name, phone number and other information supplied by the User must be accurate, current and not misleading. The account may only be used by its owner; sharing account access does not transfer the account or any license.
3. Account Security
The User is responsible for keeping the email account and active sessions secure. If unauthorized access is suspected, the User should end other sessions and contact Tematek without delay. Mandatory rights applicable to events occurring without the User's fault remain reserved.
4. Portal Services
The customer portal enables the management of licenses, licensed devices, orders, payment methods, addresses and related account information. Creating a portal account does not by itself grant any paid product, package, module or license entitlement. Purchase, payment, renewal and license conditions are governed by the agreements and notices presented for the relevant transaction.
5. Rules of Use
The User may not use the portal for unlawful purposes, attempt to bypass security controls, access another person's account or data, or interfere with operation of the service. An authorized email assigned to a licensed device does not create a separate customer account or a general right of access to the portal.
6. Changes and Service Availability
Tematek may update portal features for security, maintenance, legal compliance or service improvement. Planned maintenance and circumstances beyond reasonable control may cause temporary interruptions. Tematek will use reasonable efforts to announce significant and foreseeable changes through appropriate communication channels.
7. Suspension and Termination
An account may be temporarily suspended or restricted in the event of a security risk, misuse, false information, unlawful activity or a material breach of this Agreement. The User may request account closure. Financial, licensing, transaction and legal records may continue to be retained where required by applicable retention obligations.
8. Personal Data
Personal data is processed to operate the portal and carry out authentication, customer support, ordering, payment and licensing processes in accordance with applicable privacy notices and law. The current Privacy Policy and data protection notices are published on the website.
9. Electronic Communications
Transactional notices concerning account security, verification codes, orders, payments, invoices, licenses, renewals and service changes may be sent to operate the account and services. Where required, advertising, campaign and marketing communications are subject to a separate and optional consent. Acceptance of this Agreement does not constitute marketing consent.
10. Intellectual Property
Intellectual property rights in the DesignCAD name, software, portal, visual elements, documents and content belong to Tematek or the relevant rights holders. This Agreement does not transfer any intellectual property right to the User other than the expressly granted rights of use.
11. Agreement Versions
The version accepted by the User is retained together with its acceptance date, content digest and technical records. The User may be asked to review and accept a new version when material changes are made. Changes that do not require renewed acceptance apply from their publication date.
12. Contact and Governing Terms
This Agreement is governed by the laws of the Republic of Türkiye. Mandatory consumer rights and remedies remain reserved. Current contact channels published on the DesignCAD website may be used for questions concerning this Agreement or the customer account.
